What is the difference between getting a public defender and a regular attorney?Besides the money part?
Quite a few opinions above me here, but I will give you another thought in this.
Any person facing criminal charges has the right to have legal counsel represent them in court. The Public Defenders Office was created so that persons who do not have the funds to hire their own defense counsel will still have legal representation and not have their rights violated.
I am NOT slamming PD's here. I have known quite a few over the years and most of them truly take their jobs seriously, but they are severely overworked and usually badly underpaid. In minor cases, they will give a good court case and represent fairly. If a charge is serious or very complicated, it is usually too time consuming for most PD's to devote the necessary hours of investigation and preperation for a long "Perry Mason" defense. I personally believe that this is where they get the bad reputation from. Not so much that they are not doing their jobs, but persons who are charged with serious crimes do not want to spend anything on their own defense and expect the court system to do everything for them, including getting them off for crimes they actually did commit.
As noted above, you get what you pay for. If you are looking at a low grade misdemeanor and have no job, use the PD. If you are looking at a major felony, you might want to consider a private attorney, regardless of cost, for their ability to defend you.
